2. PERSONAL DATA

Personal data refers to information that can be used to determine personal or factual details about you, such as your name, address, phone number or email address.

3. SCOPE AND PURPOSE OF DATA PROCESSING

3.1. Server log data

When you access our website, your internet browser automatically transmits data to the server of this website, where it is temporarily stored in what is known as a log file. Until it is automatically deleted, the following data is stored:

IP address of the visitor’s device,

Date and time of access,

Website from which the visitor accessed this website and

Browser, operating system of the visitor’s device and the name of the visitor’s internet service provider.

The processing of this personal data is justified under Article 6(1)(f) GDPR. Our legitimate interest lies in ensuring the security and stability of our website.

3.2. Contact form

If you use the contact form provided on our website to get in touch with us, we process the personal data you provide (e.g., name and contact details). We use this data solely to process your inquiry.

The legal basis for data processing is Article 6(1)(a) and (f) GDPR. Data processing is necessary for communication with you and is in the legitimate interest of the company.

3.3 Product configurator

Our website also provides a product configurator, allowing you to customize our products and submit inquiries directly to us. The personal data you enter will be forwarded to a C + P specialist dealer for the purpose of processing product inquiries, contacting you and responding to your request.

The legal basis for this processing is the performance of pre-contractual measures in accordance with Article 6(1)(b) GDPR.

3.4 Data processing in the application process

If you provide us with personal data as part of a job application (e.g., name, contact details, application documents), we will process this data solely for the purpose of handling the application process. The purpose of processing is to select candidates for potential employment. Your data will not be used for any other purposes.

The legal basis for this processing is the performance of pre-contractual measures under Article 6(1)(b) GDPR in conjunction with Section 26 of the German Federal Data Protection Act (BDSG).

3.5 Google (Universal) Analytics

We use the Google Analytics service provided by Google LLC (“Google”). This service enables us to analyze the usage of our website and utilizes cookies for this purpose. The information generated by these cookies, including your anonymized IP address, is transmitted to a Google LLC server in the USA on our behalf, where it is stored and analyzed. On this website Google Analytics has been enhanced with the code “gat.anonymizeIp();” to ensure anonymized IP address collection. IP anonymization generally occurs by truncating your IP address within the European Union or other contracting states of the European Economic Area (EEA) before transmission. In exceptional cases, your IP address may be transmitted to a Google LLC server in the USA and anonymized there. According to Google, the transmitted IP address is not merged with other data held by Google LLC. As part of Google Analytics advertising features, we use remarketing and performance reports based on demographic characteristics and interests. These methods aim to align advertising efforts more closely with users’ interests based on behavioral data. Remarketing allows us to display personalized advertising on other websites based on the visitor’s browsing behavior on our pages. These ads may include products that the visitor previously viewed on our website. If you have consented to linking your web and app browsing history with your Google account and to the use of data from your Google account for personalized ads, Google will use this data for cross-device remarketing. Personal data is collected through cookies. The following data is collected:

  • App updates

  • Click path

  • Date and time of visit

  • Device information

  • Downloads

  • Flash version

  • Location data

  • IP address

  • JavaScript support

  • Pages visited

  • Purchase activity

  • Referrer URL

  • Usage data

  • Widget interactions

  • Browser information

The legal basis for processing your data in this context is Article 6(1)(a) GDPR, meaning data collection occurs only with your consent. You can object to Google Analytics tracking at any time by adjusting your cookie settings.

The personal data collected is transmitted to Google-managed servers, most of which are located in the USA. Since the EU-US Privacy Shield is no longer in effect, data transfers to the U.S. are now based solely on standard contractual clauses issued by the European Commission, along with additional safeguards. While these standard contractual clauses form the basis for data transfers, they do not prevent U.S. security agencies, which have been granted extensive authority, from accessing your personal data at any time without cause. This remains the case even if the servers are located in Europe. There are no effective legal remedies available to counter this access.

Your data will be stored for a maximum of two years.

Google Analytics 4

We use Google Analytics 4 to analyze and improve our website’s performance.

Google Analytics 4 is a web analytics and tracking service provided by Google LLC (“Google”). This service may use cookies if we enable the cookie function. In addition, Google Analytics 4 employs anonymized user and Client IDs generated by our website or app and Google Signals to identify users.

The User ID is assigned to a logged-in user once they have been clearly identified. It allows user tracking across different devices. For example, if users access the website or app via smartphones or tablets, we can use the User ID to analyze the user paths in a comprehensive data overview.

The Client ID is a unique, randomly generated string that serves as a pseudo-anonymous identifier, allowing for anonymous recognition of a browser instance. It is stored in browser cookies, ensuring subsequent visits from the same device can be linked to the same user.

Google Signals are session data from websites and apps that Google associates with users logged into their Google account and who have enabled personalized ads. By linking this data with authenticated users, Google Analytics 4 enables cross-device reports, cross-device remarketing and exporting cross-device usage results to Google Ads (“conversions”).

Since Google Analytics 4 processes personal data, it falls under Article 4(1) of the GDPR. Google Analytics 4 collects personal data in the form of user properties and event data. The latter includes automatically captured events (user activities, number of sessions, clicks on ads, which ads are viewed, removal or deletion of login data, website or app crashes, subscription completions or cancellations, clicks on links, scrolling behavior, end of viewed videos, etc.), events optimized for analysis (page views, scrolls, activation of external links, website searches, video playback, file downloads, etc.), recommended events (purchase process on the website, travel offers, games), as well as custom events (events that are neither automatically captured nor recommended). Additionally, session data is collected, such as multiple page views, events (see above), social interactions and e-commerce transactions.

User properties are attributes of users who interact with your app or website. They are used to describe user segments, such as language settings or geographic location. Some user properties are automatically logged in Google Analytics 4.

The information generated by cookies, the User ID and Google Signals regarding your use of this website is generally transmitted to and stored on a Google server in the USA. If IP anonymization is activated, your IP address will be truncated by Google within member states of the European Union or in other contracting states of the European Economic Area agreement before transmission. Only in exceptional cases is the full IP address sent to a Google server in the USA and truncated there. Google uses this information to evaluate your use of the website, compile reports on website activity, generate forecasts regarding your future web behavior and provide other services related to website and internet usage to the website operator. User ID data collected on a website or app cannot be shared or combined with data from another website or app. However, device and activity data from different sessions on a website or app can be merged and combined using the User ID or Google Signals. The collection and combination of this data enable the creation of user profiles about you.

The legal basis for processing data using Google Analytics 4 is your explicit consent under Article 6(1)(a) GDPR.

You can withdraw your consent to the processing of your personal data through Google Analytics 4 at any time by adjusting your cookie settings accordingly. Additionally, you may revoke your consent by contacting us via mail or email at datenschutz@cpbau.de.

You can also prevent cookies from being stored by adjusting your browser settings accordingly; however, please note that in this case, you may not be able to use all the features of this website to their full extent. Furthermore, you can prevent Google from collecting and processing the data (including your IP address) created by the cookie related to your use of the website by downloading and installing the browser plug-in available here:

tools.google.com/dlpage/gaoptout

You can prevent your data from being collected by Google Analytics by clicking the following link. An opt-out cookie will be set, preventing your data from being collected during future visits to this website:

DEACTIVATE GOOGLE ANALYTICS

We use Google Analytics with the “_anonymizeIp()” extension. This truncates IP addresses (“IP masking”).

3.6 YouTube functions

The provider integrates components (videos) from YouTube, LLC, 901 Cherry Ave., 94066 San Bruno, CA, USA, a subsidiary of Google Inc., Amphitheatre Parkway, Mountain View, CA 94043, USA, on this website.

This integration uses YouTube’s “-enhanced privacy mode-” option.

When you access a page with an embedded video, a connection to YouTube’s servers is established, and the content is displayed on the website via a notification to your browser.

According to YouTube, in “-enhanced privacy mode-”, data is only transmitted to YouTube’s servers – particularly information about which of our web pages you have visited – when you watch the video. If you are logged into YouTube at the same time, this information is associated with your YouTube account. You can prevent this by logging out of your account before visiting our website.

Further details on YouTube’s privacy policy are available from Google at the following link: https://www.google.de/intl/de/policies/privacy/.

The use of YouTube components is based on Article 6(1)(f) GDPR. The website operator has a legitimate interest in effectively informing and communicating with users, as well as presenting the company’s profile online.

3.7. LinkedIn Insight Tag

This website uses the conversion tool “LinkedIn Insight Tag” provided by LinkedIn Ireland Unlimited Company (Wilton Place, Dublin 2, Ireland). This tool enables targeted advertising outside this website without identifying you as a website user. It serves to analyze and optimize our online offerings, particularly for retargetingdisplaying advertising messages to users again on other websites and assigning them to target groups.

In connection with this service, we process your personal data as follows:

a) Purpose of processing

We process your personal data to use the LinkedIn Insight Tag for serving advertisements.

b) Legal basis for processing

The processing of your personal data for the use of the LinkedIn Insight Tag to serve advertisements is based on your consent in accordance with Article 6(1)(a) GDPR. You may withdraw your consent at any time via the cookie settings.

c) Recipients/categories of recipients of your personal data

We disclose your personal data to LinkedIn.

d) Storage duration of your personal data

We retain your personal data for as long as necessary to use the LinkedIn Insight Tag for serving advertisements.

Third-country processing of your personal data

LinkedIn processes your personal data in the United States. The U.S. does not provide an adequate level of data protection. However, any transfer of personal data is carried out in compliance with the conditions set out in Articles 44-50 GDPR and other relevant provisions to ensure the protection of natural persons’ rights.

More information about LinkedIn’s standard contractual clauses can be found at:

 (f) Obligation to provide your personal data

You are not required to provide personal data. The above-mentioned tracking function of the LinkedIn Insight Tag is only possible if you have enabled it.

For more information about the data processed by LinkedIn, please refer to the full Privacy Policy:

3.8 Pinterest Web Analytics

We use Pinterest Web Analytics, a web analytics program, on our website. The service provider is the American company Pinterest Inc. The company also has a European headquarters at Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland. When you visit a page that contains such a plugin, your browser establishes a direct connection to Pinterest’s servers. The plugin then transmits log data to Pinterest’s server in the USA. This log data may include your IP address, the addresses of any websites you visit that may also include Pinterest functions, the type and settings used in your browser, the date and time of your request, how you use Pinterest and cookies.

The processing of your personal data by Pinterest Web Analytics is based on your consent in accordance with Article 6(1)(a) GDPR. You may withdraw your consent at any time via the cookie settings.

Since the EU-US Privacy Shield is no longer in effect, data transfers to the U.S. are now based solely on standard contractual clauses issued by the European Commission, along with additional safeguards. As a basis for data processing with recipients located in third countries (outside the European Union, Iceland, Liechtenstein, Norway, particularly in the USA) or for data transfers to these countries, Pinterest utilizes standard contractual clauses (SCC) in accordance with Article 46(2) and (3) GDPR. SCCs are templates provided by the EU Commission designed to ensure that your data complies with European data protection standards even when transferred to and stored in third countries like the USA.

Through these clauses, Pinterest commits to adhering to European data protection levels when processing your relevant data, even if the data is stored, processed, and managed in the USA.

More information about Pinterest's Standard Contractual Clauses can be found at https://policy.pinterest.com/en/privacy-policy.

For more information about the data processed by Pinterest Web Analytics, please refer to the full Privacy Policy: https://policy.pinterest.com/de/privacy-policy.

If you are logged into Facebook when visiting our website, your visit will be associated with your Facebook account.

The purpose of using the Facebook Pixel is to tailor our advertising more precisely to your needs and interests. This allows us to display personalized advertisements to you. Facebook collects your data for analysis, tracking and implementing its own advertising activities.

The legal basis for this is your consent in accordance with Article 6(1)(a) GDPR, which you may withdraw at any time in our cookie settings.

Data processed through the Facebook Pixel is partially stored on servers located within the European Economic Area (“EEA”). However, data may also be transferred to servers managed by Meta Platforms in the USA. Since the EU-US Privacy Shield is no longer in effect, data transfers to the U.S. are now based solely on standard contractual clauses issued by the European Commission, along with additional safeguards. The transfer of personal data occurs on the basis of standard contractual clauses under which Meta Platforms commits to processing personal data in accordance with European data protection standards. However, this does prevent US security agencies, which have been granted extensive authority, from accessing your personal data at any time without cause. This remains the case even if the servers are located in Europe. As a US company, Meta Platforms may be obliged to transfer personal data of EU citizens located on servers in the EEA to US security authorities. There are no effective legal remedies available to counter this access.
